1Why has Gangster Act been imposed on me?

This Act is imposed if you are a member of a gang and commit a crime by spreading violence or terror in the society for material or economic gain. For this, a "gang chart" is created which mentions the old criminal cases registered against you.

2There is only one case against me, can I still be accused of being a gangster?

A Gangsters Act case cannot be challenged solely on the assumption that more than one base case is always mandatory. Depending on the statutory definition, rules and latest judgments, even a single qualifying offence may sometimes be relied upon. The gang chart, alleged gang activity, approvals and factual foundation should be examined by an advocate.

3Why is bail difficult in Gangster Act?

It has very stringent conditions for bail, just like the NDPS Act. The opposition from the public prosecutor is very strong and bail is usually granted only by the High Court.

4I have received a notice to attach my property, what should I do?

Under Section 14(1) of the Gangster Act, the District Magistrate (DM) has the power to confiscate property acquired through crime. You have to prove that you have acquired the property legitimately and not through crime.

5What is Gunda Act and how is it different from Gangster Act?

Goonda Act is a preventive law. Its purpose is to banish habitual criminals to the district badar (out of the district) for a certain period so that they cannot commit crimes. It is less stringent than the Gangster Act.

Respond to notices on time. Oppose District Badar by putting the status of old cases, acquittal orders, social proof, family and employment documents.

11Is just one case under Gunda Act sufficient?

The basis of habitual criminality and fear in the society should be seen. Only a case involving a weak or personal dispute may be challengeable.

12What is the difference between Gangster and Gunda Act?

The Gangster Act is a harsh penal law focused on organized crime and economic/material gain. The Goonda Act is mostly preventive, with actions like District Badar taking place.
